A participatory process is a sequence of participatory activities (e.g. first filling out a survey, then making proposals, discussing them in face-to-face or virtual meetings, and finally prioritizing them) with the aim of defining and making a decision on a specific topic.
Examples of participatory processes are: a process of electing committee members (where candidatures are first presented, then debated and finally a candidacy is chosen), participatory budgets (where proposals are made, valued economically and voted on with the money available), a strategic planning process, the collaborative drafting of a regulation or norm, the design of an urban space or the production of a public policy plan.
The City Council of Esparreguera launches the public consultation following the preliminary draft regulation of the adapted transport service.
The City Council of Esparreguera, through this space, enables an access point to the procedures for prior public consultation in the process of drafting the draft decrees and regulations, in accordance with article 133 of Law 39 / 2015, of October 1, of the Common Administrative Procedure of Public Administrations.
Preliminary draft regulation adapted transportation
The Town Council of Esparreguera provides the adapted transport service.
On February 21, 2008, the Plenary Session of the Corporation initially approved the Regulation of transport service adapted to access specialized social services for the elderly and for people with disabilities.
The deployment of the social services portfolio has led to the definition of the adapted transport service and that specialized social services, especially aimed at people with intellectual disabilities, have been specialized. If up to now, the Can Comelles Occupational Workshop was the reference center for people with intellectual disabilities in the municipality over the last years and, in accordance with the opinions of the assessment and guidance team Work has been directed toward other resources and specialized social services. So, today we meet citizens of Esparreguera who are users of the Specialized Attention Center Arc de Sant Martí de Martorell and the Occupational Workshop Alba de Molins de Rei.
Problems that are intended to solve with the initiative:
By approving this regulation, it is intended to update and regulate the provision of the adapted transport service with the aim of making it possible for people with disabilities or dependency to access specialized social services of reference in the municipality of Esparreguera that allow to guarantee their integration.
Need and opportunity for its approval:
It is necessary to proceed to the modification of the Regulation in order to update the document to the current reality of the service and provide coverage for access to these new services.
Objectives of the norm:
The purpose of this regulation is to regulate the provision of the adapted transport service offering a complementary service to support specialized social services for people with disabilities or dependence, consisting in the provision of a transport system adapted to the degree of necessity of support to the possible users for the access to the following specialized social ones of reference of the municipality of Esparreguera:
a) Day center service for senior citizens of a temporary or permanent nature.
b) Temporary or permanent specialized day care service for people with intellectual disabilities.
c) Services of Occupational Therapy Day Centers (STO) for people with intellectual disabilities.
d) Occupational insertion center (SOI) service for people with intellectual disabilities.
Possible alternative regulatory and non-regulatory solutions:
Article 4.1.a) of Law 7/85, dated April 2, regulating local government bases, grants the town councils the regulatory power, that is, the capacity to develop, within the scope of their powers, what is available in the state or autonomous regulations.
It is understood that the regulatory development of the transport service adapted to the City of Esparreguera by means of a regulation is the right solution; especially when it comes to regulating relationships with citizens that go beyond mere internal management.
It is necessary to have an updated regulation of the adapted transport service to guarantee an improvement in quality in the attention and provision of the adapted transport service.
